"The Certified Organic Difference"

The beers marked with an asterisk are certified organic. The other listed beers are made using organic ingredients but they are not certified. Breweries that use organic ingredients but choose to not be certified can do so under the restrictions for exempt operators set forth in the National Organic Program (NOP). What are the differences and what kind of organic claims can be made?

Except for exempt or excluded operations, any person, operation, or specified portion of a operation, that sells, labels or represents their products as “100% organic,” “organic,” or “made with organic (specified ingredients or food group(s)), must be certified to the applicable sections of the NOP regulation 7 CFR 205. This means that the operation is monitored by a USDA accredited 3rd party certifier and inspected annually. If an operation knowingly sells or labels a product with one of the three claims specified above without being certified, they are subject to a civil penalty of not more than $11,000 per violation. The specification of the term “per violation” is up to the discretion of the NOP.

The NOP regulation establishes several categories of exempt and excluded operations. An exempt or excluded operation does not need to be certified, however operations that qualify as exempt or excluded may voluntarily be certified. Common examples include retail establishments such as a grocery store or a restaurant, warehouses that simply store organic product, brokers that do not physically handle the organic product, or products that only make an organic claim in the ingredient statement of the product label.

While exempt or excluded operations do not need to be certified, they are still subject to the contamination and commingling prevention requirements and the labeling requirements specified in the regulation. In other words the operation must protect the organic integrity of the organic ingredients used in the product and they cannot make any claims about certification or make any organic claims on the front of the product label. Furthermore the exempt producer or handler must maintain records sufficient to prove that the ingredients or products identified as organic were produced and handled in accordance with the regulations. These records must be maintained for no less than 3 years and be available for inspection and copying by NOP representatives or State Organic Program officials.
